Vending and stand license
According to the Eilandsverordening Algemene plaatselijke verordening Sint Eustatius (AB 2018/29), and Legesverordening Sint Eustatius 2021, each person that wishes to conduct any of the above on St. Eustatius must be in possession of a valid License.
Request forms can be obtained by the Unit Licenses, Supervision, Enforcement located on Kenniproad 15.
Vending
1. It is prohibited without authorization from the Executive Council:
a. To offer for sale, to sell or to issue goods on the public road or a public water or other accessible to the public and in the outdoor location;
b. To offer for sale or sell food and drink from house to house;
2. The prohibition referred to in the first paragraph does not apply: a. In respect of the offering for sale, sale or delivery of printed documents in which thoughts or feelings are not disclosed as referred to in article 8, first paragraph of the State Arrangement (Staatsregeling); b. For the offering for sale, sale or delivery of goods to a place referred to as stand, mentioned under the topic Stand/Display;
3. A license as referred to above may be refused:
a. In the interest of public order;
b. In the interest of the prevention or reduction of pollution;
c. In the interest of the traffic freedom or safety;
d. In the interest of public health;
Persons below the age of sixteen years
- Vending by persons below the age of sixteen years is prohibited;
- He/she, which carries supervision over persons below the age of sixteen years, is required to ensure that he/she don’t vent;
Stand/Display
1. It is prohibited without authorization from the Executive Council on the public road or on public water or on another location open to the public or outdoor location:
a. To occupy a stand with a vehicle, a stall, a table, or any other means to have or exercise the trade of goods, to offer for sale, to sell or to provide, or to offer services;
b. To display goods to offer for sale, to sell or to provide to the public;
c. Alcohol sale is prohibited without an approval from the Vergunningwet BES;
2. It is forbidden to have chairs or other seating in the vicinity of the vehicle or any other means referred to in the first paragraph.
3. It is the rightful claimant of a plot prohibited, that without authorization of the Executive Council a stand will be occupied or goods will be displayed as referred to in the first paragraph.
4. In the first paragraph, under b, the prohibition does not apply in respect of the displaying printed documents in which thoughts or feelings are not disclosed as referred to in article 8, first paragraph of the State Arrangement (Staatsregeling).
5. Therefore, also the prohibition in the third paragraph does not apply.
6. A License as referred to in the first paragraph may be refused:
a. In the interest of public order;
b. In the interest of the prevention or reduction of pollution;
c. In the interest of the traffic freedom or safety;
d. In the interest of public health;
e. In the interest of the protection of the appearance of the surroundings;
Both Vending and Standplaats License requests need to be submitted at least 60 days in advance.
Costs are: $7 per day and $ 1000 per year for Standplaats.
$7.- per day and $ 300 per year for a Vent License.
