Bringing prohibited items into the JICN punishable by law
Bringing prohibited items into judicial institutions is officially punishable in the Caribbean Netherlands. The Wetboek van Strafrecht BES (BES Criminal Code) makes it possible to prosecute those who attempt to bring in contraband. From now on the Judicial Institution Caribbean Netherlands (JICN) enforces this law more strictly it shall report people who try to smuggle in prohibited goods
Not only items that are not permitted in free society, such as weapons and drugs, are prohibited in judicial institutions. Also items, of which the possession is not illegal outside the institution, could nevertheless be prohibited in judicial institutions. This applies to items whose possession or use could endanger order and security in the institution. Examples are phones, tools and data carriers like USB sticks.
The possession of these prohibited items in the institution increases the risk that criminals continue to act in a criminal manner during their sentence or measure. Moreover, it interferes with the proper reintegration of detainees. By strictly enforcing the penalisation of bringing in contraband, one is further discouraged from carrying contraband for inmates.
Binnenbrengen van verboden voorwerpen in de JICN wettelijk strafbaar
Het binnenbrengen van verboden voorwerpen in justitiële inrichtingen is officieel strafbaar gesteld in Caribisch Nederland. Het Wetboek van Strafrecht BES maakt het mogelijk om personen die contrabande proberen binnen te brengen strafrechtelijk te vervolgen. De Justitiële Inrichting Caribisch Nederland (JICN) handhaaft nu strenger op deze wet en zal voortaan aangifte doen tegen mensen die verboden goederen proberen binnen te smokkelen.
In justitiële inrichtingen zijn niet alleen voorwerpen die in de vrije maatschappij niet toegestaan zijn, zoals wapens en drugs, verboden. Ook bepaalde voorwerpen waarvan het bezit ervan buiten de inrichting niet illegaal is, kunnen in justitiële inrichtingen toch verboden zijn. Het gaat daarbij om voorwerpen waarvan het bezit of gebruik ervan de orde en veiligheid binnen de inrichting in gevaar brengen. Voorbeelden hiervan zijn telefoons, gereedschap en informatiedragers zoals usb-sticks.
Het bezit van deze verboden spullen in de inrichting vergroot het risico dat justitiabelen tijdens hun straf of maatregel doorgaan met crimineel handelen. Bovendien staat het een goede re-integratie van gedetineerden in de weg. Door strikt te handhaven op de strafbaarstelling van het binnenbrengen van smokkelwaar wordt men verder ontmoedigd om contrabande voor justitiabelen mee te brengen.
